Subtração internacional de crianças à luz do caso Sean Goldman

ResumoO presente artigo aborda a subtração internacional de crianças e adolescentes, que consiste no deslocamento ilegal de menor, efetuado normalmente por um dos genitores, do local de sua residência habitual para país diverso, sem o consentimento do outro genitor. Serão estudados os principais dispositivos da “Convenção sobre os Aspectos Civis do Sequestro Internacional de Crianças”, concluída em Haia no dia 25 de outubro de 1980, que será analisada à luz do ordenamento jurídico brasileiro, detendo-se em uma situação concreta —o caso Sean Goldman—, que teve grande repercussão no País devido às suas peculiaridades, ensejando uma batalha judicial entre o pai americano e a família brasileira do menor, resultando no retorno do menino aos Estados Unidos.

This article examines the international abduction of children and teenagers, which consists on the wrongfully removal or retention of children from their habitual environment, usually by one of the parents, without the consent of the natural or legal person lawfully exercising the right of custody. The main aspects of The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction will be assessed in the light of the Brazilian legal framework as applied in a real situation —the Sean Goldman case— that had great repercussion in Brazil because of its particularities, which resulted in an judicial dispute between the American father and the Brazilian family of the child, that ultimately resulted on the prompt return of the child to the United States.

RésuméCet article aborde ĺenlèvement international d́enfants et des adolescents, défini comme étant le déplacement illicite d́un enfant mineur dans um pays étranger, sans ĺaccord de ĺautre parent. Les principales dispositions de la «Convention sur les Aspects Civils de l’Enlèvement International d’Enfants», conclue à La Haye le 25 Octobre 1980, seront étudiés. Ce traité international será examiné à la lumière des règles du système juridique du Brésil, s’arrêtant face à une situation reélle —ĺaffaire Sean Goldman— qui a eu un grand impact au Brésil en raison de ses particularités, occasionnant une bataille judiciaire entre le père américain et la famille brésilienne de l’enfant, entraînant son retour aux États-Unis.
