Abstract
People become vulnerable when aging and often need legal protection. The family must therefore find a suitable solution. How to settle a both efficient and respectful protection of the person? Principles of necessity, subsidiarity and proportionality have been re-assessed in the French reform of the weak person's protection. The elderly should be respected in their dignity and useless protection measures should be avoided: “to protect” does not mean “to weaken”.
