Abstract
Following the attacks in January and November 2015, France passed laws specially turned to terrorism prevention, increasing the powers of judicial police and the prosecution, by the use of proactive investigations highly intrusive. New offenses relative to advocating terrorism revive the debate about the legitimacy of such offenses, including under the principal of legality of offenses and penalties.
