Abstract
To keep making progress on renewable energy deployment, state incentives must be structured to comply with constitutional requirements. While states can experiment, and indeed have taken the lead on renewable policy initiatives, the programs must be carefully sculpted within the legal parameters of the dormant Commerce Clause.
