Abstract
Now that an appeals court has vacated the Environmental Protection Agency's new Cross-State Air Pollution Rule and left the Clean Air Interstate Rule in place, many states and utilities are rejoicing, glad for the reprieve. But the decision created clear winners and losers—and many of those who are jubilant now might not like what they see when EPA responds to the decision in a few years.
