Abstract
This paper aims to lay a foundation to build a Latin American private ius commune, for which examines the regular sequences from Indian law to current positive law and defends that, prior to any attempt at positive harmonization, the creation of a common legal culture Latin American is more important, and a first step to this is a programme of work that unifies the unsystematic current legal harmonization proposals.
