Abstract
My aim is to clarify the biolegal scopes of biolaw by defining it as a law of principles, which can guarantee the identification and recognition of biorights or fourth generation human rights in LatinAmerican legal systems through a constitutional reception of international standards on individual subjective rights. Also, I will demonstrate how biolaw is able to identify new categories of damages in the field of reparation law, for instance, genetic harm. The above mentioned would permit the State to meet its international obligations in this matter as well as make those rights effective within the internal jurisdictional context.
