Abstract
Equal employment is one of the most important and problematic questions of the labour market and of employment law as well. Within Europe we should pay special attention to the practice of the Court of Justice of the European Union because of its general legal practice. The study describes new cases which represent the development of equal treatment. Furthermore, special attention is paid to the European Convention on Human Rights emphasizing that this question cannot be described only from the point of view of labour law. The final conclusion is that the Court is in a difficult situation when judging correctly a labour law discrimination case since it has to take into consideration several aspects which interpretation is not united in the European labour law.
