Database right and the ECJ judgment in BHB v. William Hill: Dark horse or non-starter?

On 9 November 2004 the European Court of Justice gave its first judgments on database right, itself a creature of European Union law, in a series of cases. It is to be hoped that the Court of Appeal will salvage some coherence from this odd judgment when the case returns to that court.
