Abstract
The article presents an analysis of the laws related to participation of the actual guardian in the diagnostics and therapeutics of a minor patient. The actual guardian is authorized to consent to testing if the patient does not have a legal representative, or no one can communicate with him. The extent to which it is authorized to consent is that he has the right to information needed to develop a position on this issue. To obtain information in other cases, it required the authorization of a legal representative. Also, access to medical records requires the consent of the guardian, who is the actual legal representative.
