RésuméGrâce à la créativité des chirurgiens et à l’introduction de nouvelles technologies, la seconde moitié du xxe siècle a ouvert l’ère des innovations et de progrès déterminants. Parallèlement, cependant, est né un esprit de méfiance et de revendication qui s’est accompagné d’une juridiciarisation croissante et menaçante. L’évolution des structures complexes de notre société jointe à l’ingéniosité sans limite des chercheurs met en demeure le droit et le cadre juridique de s’adapter sans cesse. Dans le domaine de la chirurgie, il convient de concilier la liberté nécessaire à l’innovation et l’indispensable protection des patient(e)s et de leur dignité. Le cadre juridique qui régit, aujourd’hui, l’innovation en matière de chirurgie doit encore évoluer et se préciser. La dignité, paradigme incontournable pour tous ceux qui cherchent à mieux comprendre et à mieux protéger l’homme apparaît comme la limite infranchissable à toute recherche et à toute expérimentation.
