Abstract

ObjectiveThe definition of mobbing is imprecise, which causes a number of problems with a discrimination between the legitimate right of an employer to make behavioral assessments of their employees on the one hand, and the abuse of such a right on the other. It is of great importance to resolve the issue in such a way that alleged incidents of mobbing do not prevent employers from carrying out their legitimate activities, but also such that solid grounds are provided for employees who wish to seek legal defence. If an employee suffers from a health disorder linked to mobbing, the issue of compensation is also at stake.Case reportBased on forensic-psychiatric-psychological assessment and on the literature available, the report indicates the difficulties that experts face in their daily practice when evaluating a health disorder that may be caused by mobbing.ConclusionThe distinction between pre-existing mental abnormalities and those acquired as a result of unlawful practices, involved in mobbing, requires a thorough and in-depth assessment on the part of forensic psychiatrists and psychologists.
