Abstract
This article explores the application of “the public interest” test for refusal to disclose information subject to a Freedom of Information Act 2000 request. While the concept of the public interest is left open in the legislation there is a good supply of jurisprudence and guidance available to decision makers indicating how the public interest might apply to the exemptions available under the Act.
