Abstract
⺠Many endangered species laws allow exceptions to prohibitions via incidental take provisions. ⺠We argue that the exceptions apply the theory of demographic compensation to endangered populations. ⺠We model an endangered species and demonstrate how compensation can alleviate the effects of take. ⺠We conclude that the capacity to compensate should be considered in incidental take assessments.
