ZusammenfassungFür Organisationsfehler im Krankenhaus haftet derjenige, der für den Fehler konkret (mit) verantwortlich ist (z.B. Chefarzt, Ärztlicher Direktor, Pflegedienstleiter, Verwaltungsdirektor oder Geschäftsführer eines Krankenhauses). Nach der Rechtsprechung des Bundesgerichtshofs ist Personalmangel keine Entschuldigung für die Nichteinhaltung des Behandlungsstandards. Nach einem Urteil des Arbeitsgerichts Wilhelmshaven hat der Chefarzt einen Anspruch gegen den Krankenhausträger auf Bereitstellung des erforderlichen Personals. Eine Vorhaltung des Facharztstandards „rund um die Uhr“ ist erforderlich. Es ist darauf zu achten, dass kein Personal eingesetzt wird, welches nach einem vorangegangenen Nachtdienst übermüdet ist. Eine zeitnahe Information über therapeutische Konsequenzen aus der Krankenhausbehandlung an den nachbehandelnden Arzt ist geboten. Eine Risikoprophylaxe durch eine Expertengruppe als Risk-Management ist sinnvoll und wird von einzelnen Haftpflichtversicherern gefordert.
