A IDEIA DE CONSTITUIÇÃO: UMA PERSPECTIVA OCIDENTAL‐DA ANTIGUIDADE AO SÉCULO XXI

RESUMOO artigo defende a tese de que a ideia de Constituição não se alterou desde a Antiguidade Clássica Ocidental até a atualidade. Parte‐se da assunção de que a essência da Constituição, isto é, para o quê ela serve, não sofreu grandes alterações desde então. Defende‐se, pois, que o papel da Constituição se traduz na necessidade de melhor organizar o Estado e de limitar o exercício do poder. Não se trata, assim, de um trabalho jurídico, prescindindo‐se da análise de textos normativos, mas de um trabalho de história política constitucional. Trata‐se, também, de uma crítica ao entendimento de que houve uma grande ruptura nos séculos XVII/XVIII com a prática e a teoria constitucionais anteriores.

ABSTRACTThis article defends the thesis on the permanence of the idea of Constitution since the Western Classic Antiquity until current days. It departs from the assumption that the Constitutional essence suffered no substantial modifications since then. It defends then that the Constitutional role is to present a better State organization and the limitation of the power exercise. Then, this is not a legal work, since it does not analyze normative texts, but a political historic work on constitution. It is also a critic to the interpretation about a great disruption on previous constitutional practice and theory during 17th/18th centuries.
