In this paper a phenomenological approach is proposed to describe the inelastic behavior of a material. It is based on the generalization of the Gibbs' relation outside from the equilibrium for uniform system. The fluctuation theory is used to analyze the material dissipation due to its internal reorganization. The present theory does not use the notion of the yield criteria in the model development. In order to show the prediction capability of the theory, we carry out the determination of the yield surface as a response of the model. The effects of the hydrostatic stress and the accumulated loading (memory effect) with and without pre-loading on the yield surface distorsion are examined.
