La protección de los derechos fundamentales del deportista en la lucha contra el dopaje. Una visión desde el ordenamiento jurídico español*

ResumenEl dopaje es abordado aquí desde dos dimensiones: por una parte, se estudia el régimen jurídico creado al efecto en aras de su prevención y lucha; y, por otra, la colisión que desencadena el mecanismo del control antidopaje con un derecho fundamental como es la intimidad del deportista. Partimos del hecho irrefutable de que la “conciencia contra el dopaje” es prácticamente universal. El quid de la cuestión radica en que la legislación antidopaje a nivel mundial—y por extensión la ley antidopaje española—habilita a los profesionales sanitarios y a otras personas implicadas a practicar los pertinentes controles antidoping que puedan crear conflicto con un derecho fundamental como el derecho a la intimidad del deportista, todo ello en un contexto de fuerte impacto mediático y social. Con todo, es pertinente plantearse si la exigencia del control antidopaje y el deber de localización permanente quedan suficientemente justificados sobre la base de la protección de la salud del deportista.

Doping is addressed in this paper from two different scopes: on one hand, the legal regulations for prevention and repression are studied; on the other hand, the clash between the anti-doping control mechanism and a fundamental right such as the athlete's privacy is noted. We start from the irrefutable fact that “awareness against doping” is practically universal. The enactment of this law was a milestone in the history of the fight against doping in the Spanish regulation. However, the problem arises when the anti-doping legislation worldwide and in Spain, which enables some healthcare professionals and other people involved, to carry out several anti-doping operations that may conflict with the athlete's fundamental right to privacy, all of this in a context of strong media and social impact. For this reason, it is pertinent to raise the issue if one of these operations, such as the duty of permanent localization, is sufficiently justified in terms of protecting the sportsperson's health.
