Reconocimiento y ejecución de sentencias mexicanas de divorcio en venezuela*

ResumenLa sentencia la dicta el juez competente para proceder a su ejecución, y materializar así la justicia que aspira todo proceso judicial. Pero en la fase de ejecución se pueden presentar varias circunstancias, no sólo si se trata de ejecución forzosa, en defecto de ejecución voluntaria, sino también cuando dicho juez se encuentra imposibilitado por razones territoriales para proceder a su ejecución, ya sea porque el objeto del litigio está en otro Estado o los efectos desean hacerse valer más allá de las fronteras del Estado en el cual se dictó. El cruce de fronteras geográficas no debería alterar las situaciones jurídicas válidamente constituidas en un Estado determinado; para ello es importante establecer mecanismos que permitan el reconocimiento y eficacia extraterritorial de las decisiones jurisdiccionales de un Estado en otro. A partir de dos casos conocidos por el Tribunal Supremo de Justicia venezolano se analiza la problemática en torno al reconocimiento y ejecución de sentencias mexicanas de divorcio en Venezuela, según la Convención Interamericana sobre el tema y la normativa interna aplicable.

Judges rule their decisions to enforce foreign divorce judgments and therefore to achieve procedural justice. Notwithstanding of that, the enforcement couldface different challenges, not only about its coercive enforcement —lacking of voluntarily compliance of the original decision— but also ju-risdictional/territorial limitations. These limitations are related with the existence of different locations among the place of the original subject matter, the place of its effects and, the place where the enforcement decision will be ruled. However, geographical boundaries should not affect vested rights. Therefore, it is crucial to grant mechanisms that will ensure the enforcement of foreign decisions. Based on two Venezuelan Supreme Court decisions, this document analyses issues related with the enforcement in Venezuela of Mexican divorce judgments, considering both the Inter-American Convention on Extraterritorial Validity of Foreign Judgments and Arbitral Awards and Venezuelan domestic rules.
