¿CÓMO AFRONTA EL DESAFÍO DE LA SOBRECARGA DE TRABAJO EL TRIBUNAL CONSTITUCIONAL DE ESPAÑA?

RESUMENCon este trabajo se busca mostrar cómo el Tribunal Constitucional de España ha enfrenta-do el desafío de la sobrecarga de trabajo y cuáles han sido los resultados hasta ahora observables de la última reforma sobre el modo en que este tribunal tramita los amparos (realizada en 2007). Con esta finalidad, se explicarán cuáles son los nuevos requisitos que introdujo esta reforma al amparo constitucional, en qué medida estos cambios facilitan la labor del Tribunal Constitucional y cómo éste aplica y especifica las nuevas exigencias procesales. A su vez, se intentará hacer un balance del impacto que produjo la reforma mencionada en la capacidad de trabajo y progreso sobre las tareas atrasadas del Tribunal Constitucional.

ABSTRACTThis paper seeks to show how the Cons-titutional Court of Spain has tackled the problem of having an excessive workload, by analyzing the most noticeable results that have been accomplished by the last reform carried out in 2007, with a special emphasis on the way this Court processes the amparo appeals. With this in mind, this paper offers an explanatory description of the new requirements the amparo appeal must meet, and studies to what extent the 2007 amendments have facilitated the work of the Spanish Constitutional Court, and how the latter applies and specifies such requisites.
