EL RÉGIMEN DE LA UNIVERSIDAD Y SUS FACULTADES DISCIPLINARIAS EN LA TRADICIÓN ANGLOSAJONA

RESUMENLa noción de la existencia de un contrato entre el estudiante y la institución de educación superior, ya sea explícito o implícito, ha cobrado carta de naturalización en el sector privado e incluso se ha extendido al sector público. El carácter oneroso de la educación superior privada ha implicado la asimilación del alumno a la condición de consumidor, y por lo tanto, a mecanismos de protección del consumidor, así como a la acción de profesionistas y grupos de interés que defiendan sus derechos. En el derecho nacional sólo se ha planteado el tema en forma incipiente, por lo que es conveniente conocerlo para decidir sobre la conveniencia de su adopción y adaptación a una tradición igualmente rica, pero hasta el momento relativamente distante.

ABSTRACTTo an observer from the Civil Law system, the recent developments may appear as if the legal relation binding the institution, as provider of the public service of education and their students is beginning to look like a contract liable to be enforced by agencies and courts, wherein lawyers represent their clients claims and appeals. The article is addressed to lawyers and scholars in the countries of Civil Law tradition where similar developments are beginning to take place, so as to consider the convenience of adapting the procedures and solutions already existing in the Common Law system, taking into account the special needs and legal institutions of their own countries.
