LEGALIDAD Y CONVENCIONALIDAD COMO BASE DEL SISTEMA PENAL ACUSATORIO EN MÉXICO

RESUMENEn este texto se pretende analizar el principio de legalidad en materia penal y su relación con la convencionalidad introducida al texto constitucional mexicano en junio de 2011. Todo ello, dentro del sistema penal acusatorio delineado en la Constitución Política de los Estados Unidos Mexicanos a partir de la reforma de 2008 y en el Código Nacional de Procedimientos Penales. La reflexión gira en torno al análisis sobre ¿cómo los jueces locales deben aplicar la convencionalidad en materia penal?

ABSTRACTThis text tries to analyze the principle of legality in criminal matters and their relationship with the conventionality introduced the text Mexican Constitutional in June 2011. This is within the accusatory criminal system outlined in the Political Constitution of the Mexican United States from reform of 2008 and the National Code of Criminal Procedure. The reflection revolves around the analysis of how local judges should apply the conventionality of criminal matters?
