Jury verdicts, settlement behavior and expected trial outcomes

► Little is known about how litigants form expectations about likely trial outcomes. ► Forming expectations based on tried cases can make litigants less likely to settle cases. ► I find that an increase in average verdicts changes settlement behavior in similar cases. ► In response, litigants appear to be more willing to go to trial with relatively less valuable cases.
