► We study the causal impact of medical malpractice liability on social welfare. ► Growth in malpractice payments contributed up to 15% of growth in medical costs from 1990 to 2003. ► The threat of malpractice liability also led to modest mortality reductions during this period. ► Reducing liability may not be cost-effective given conventional value of life estimates.
