Mobile-Sierra's Less Than Golden Anniversary

Because the public interest is protected in any event, it is only private interests that are benefited when Mobile-Sierra protections are withdrawn from a given contract or class of contracts. In furthering these private interests, however, the courts and FERC are jeopardizing the public interest.
