ترجمه چکیده
تکامل قانون باعث ظهور اصول تفسیری می شود که می تواند به چندین منبع رسمی اعمال شود. بنابراین، اصول تفسیر در رابطه با قانون و قانون اساسی توسعه یافته است. روند مدرن نسبت به تحقق قانون، مسئله اصول تفسیر حقوق اساسی را مطرح می کند. این نوع تفسیر حقوق بنیادی، یک تغییر پارادایم را به سمت عدالت مادی می آورد. این مقاله به دنبال آن است که روش قضایی در مورد قانون اساسی شیلی را بررسی کند و برخی از این اصول تفسیر حقوق اساسی را در بر گیرد.

چکیده انگلیسی
The evolution of the law caused the emergence of principles of interpretation that can apply to several formal sources. Thus, principles of interpretation have been developed related to the law and the Constitution. The modern trend towards the materialization of the law raises the question of the principles of interpretation of the fundamental rights. This type of interpretation of the fundamental rights would point out a paradigm shift, towards a material justice. This paper seeks to analyze the way the case law -mainly the Chilean case-law- is incorporating some of these principles of interpretation of the fundamental rights.
