Responsabilidad médica

ResumenEl presente artículo intenta abordar de una manera inteligible para el lector no jurista la nueva realidad de la actividad médica en relación a la responsabilidad del médico por sus actos evitando los tecnicismos legales y sacrificando la precisión legal en beneficio de la mejor comprensión del texto. Analizaremos la responsabilidad médica en base a las normas y principios que inspiran nuestra legislación, y la aplicación de los mismos que efectúan nuestros tribunales de justicia. Especial atención se otorga al consentimiento informado y a la confidencialidad médica, temas a los que se les dedica un acápite especial. Asimismo, analizaremos en un acápite especial otro tema íntimamente relacionado con la responsabilidad del médico, como es el seguro de responsabilidad civil existente en el mercado y que protege patrimonialmente al médico frente a reclamaciones de terceros, tema muchas veces desconocido, pero que hoy se vuelve indispensable frente a la nueva realidad de la actividad médica.

SummaryThe present article intends to give an approach in an intelligible way for the non-jurist reader concerning the new reality in the medical activity, in relation to procedures avoiding legal technicalities and to sacrifice legal precision so as to gain a better understanding of the text. We will analyze the medical responsibility on the basis of the rules and principles which inspire our legislation and their application that our judicial courts apply. A special attention is given to the informed consent and the medical’s confidence, themes that will be given a special treatment. Likewise, a special analysis will be made to another intimately paragraph in relation to the medical responsibility, such as the civilian insurance responsibility present in the market, which protects the doctor in a patrimonial way compared with another one’s claiming, many times this topic unknown but now indispensable compared with the medical’s activity reality.
