Implication in a judiciary procedure related or not to medical malpractice is a potential issue for health care providers. It may occur even after simple anaesthetic procedures. Through a case report of inhalation of gastric content during gastrointestinal endoscopy leading to a prolonged stay in intensive care and complication, we report judiciary expertise proceedings conducted by the French arbitration and compensation committee (Regional Commission for Conciliation and Compensation of Medical Accidents [CRCI]) and describe the case analysis by medical experts according to their judiciary committments.
