Since the development of the techniques of medically assisted reproduction, the available modalities of reproduction have raised many legal and ethical issues. Because anything, or almost anything, is possible, the question becomes one of limitations. One of the interrogations concerns surrogate gestation, which is legal in certain countries but prohibited in France by article 16-7 of the civil code. A recent decision by the Paris appeals court revived the debate. The court, for the first time, recognized the maternal filiations of two children born in the United States to a surrogate mother. While this decision does not contradict the prohibition of surrogate gestation, it does nevertheless point out a certain lack of coherence in the French legal system: how can the prohibition of surrogate gestation be maintained if the filiations issuing from this very process (effective in another country where it is legal) are recognized?
