Dangers pour la personne de confiance : vers une équité de sa désignation

Sick people need support during their illness, both psychological help and support for decisions. In France, the legislator has established the person of trust (PC). As the PC is in close contact with care, he or she can be subjected to a particular stress. For example, PC may consider its role as a determinant in medical decisions. Some studies show higher prevalence of reactive disorders such as posttraumatic stress disorder, in the PC compared to other people. From this, we wonder about the ethical issues for the designation of the confidential. How to designate a PC person without subjecting it to excessive risk to his or her health? We questioned the possibilities offered by the law. We propose a fair designation of the PC according accompaniment thereof by the medical profession.
