Un revirement jurisprudentiel important en matière de responsabilité médicale pour défaut d'information

The ruling given on 3 June 2010 by the main chamber of the Appeal Court is fundamental in terms of medical responsibility linked to a lack of information. Effectively, not only does it recognize any compensation which may occur as a result of a failure to inform the patient about the risks run, even when knowledge of this risk would not have affected the patient's consent, it also paves the way for the recognition of the “right to know” as a subjective right.
