Auteurs d'infractions dont le discernement était altéré ou aboli au sens de l'article 122-1 du Code pénal : étude descriptive sur 180 sujets

We found a high rate of authors suffering from a psychiatric disorder influencing their discernment. Mental disorders conducting to abolished or diminished discernment are various, however, schizophrenic disorders are the most frequently reported. Authors with abolished discernment differ from patient with diminished discernment. Infractions committed during psychiatric pathological states are various. However, some infractions seem to be more specifically committed. Most of these are not focused by specific Laws and may not benefit from psychiatric investigation. This may explain the high psychiatric morbidity in French penitentiaries. Actions are proposed.
