Les expertises demandées par les juges aux affaires familiales dans les cas de séparation parentale

RésuméLes expertises demandées par les juges aux affaires familiales concernent un petit nombre de cas de divorces ou de séparations parentales, parmi les plus difficiles. Le juge aux affaires familiales y a recours lorsqu’il pense que les parents et les enfants ont besoin d’être entendus de manière approfondie dans un cadre approprié par un spécialiste en santé mentale infantile. Cet article donne un bref aperçu de l’évolution des liens familiaux dans la société contemporaine. Il décrit ensuite le cadre juridique de l’expertise constituée : premièrement, par les textes de loi se rapportant à la famille, au divorce ou à la séparation, aux fonctions parentales ; deuxièmement, par les attributions du juge et celles des experts ; troisièmement, par les questions posées par le juge à l’expert. Il aborde la manière de conduire l’expertise et les méthodes utilisées en insistant sur le fait qu’il s’agit d’un travail nécessitant l’accord réel de chacun des parents et sur l’importance de l’audition des enfants. Il présente les différentes situations rencontrées : conflits autour de la résidence des enfants, conflits autour des droits de visite et d’hébergement, situations particulières caractérisées par la maltraitance, la souffrance psychique de l’enfant, la pathologie mentale d’un parent… Il évoque les références théoriques sur lesquelles peut s’appuyer l’expert en insistant sur l’importance des liens familiaux après le divorce. L’auteur présente le concept de « constellation familiale complexe » issue de la séparation parentale. L’expertise pédopsychiatrique dans le cadre de la justice de la famille ne peut constituer une lecture réellement objective d’un fonctionnement familial mais, au-delà de sa mission strictement judiciaire, elle peut s’accompagner d’un certain effet thérapeutique.

The expert reports demanded by the judges of family matters concern a small number of divorce cases or those of parental separation, amongst the most difficult. The judge of family matters can resort to this measure when he thinks that the parents and the children need to be heard at greater depth, in an appropriate framework, by a specialist in child mental health. This article provides a few ideas on the development of family tie in contemporary society. It then goes on to describe the judicial framework, thus, composed of the experts report: firstly, through the legal texts referring to the family, to divorce or separation, to parental functions; secondly, through the competence of the judge and that of the experts; thirdly, through the questions asked by the judge to the expert. It broaches the subject of how to conduct the expert's report and the methods used, whilst insisting on the fact that this work requires the genuine agreement from both parents and the importance of hearing the children. It presents the different situations encountered: conflicts of the subject of the children's residence, conflicts concerning visiting rights, particular situations characterized by abuse, psychological suffering of the child, parental mental pathology… It evokes the theoretical references on which the expert can refer to whilst highlighting the importance of family relations following divorce. The author presents the concept of “complex-family constellation”, outcome of parent's separation. A Child psychiatry report, in the context of family justice, cannot constitute a wholly objective appreciation of the functioning of the family, however, beyond its strictly judicial aim, it can produce a certain therapeutic effect.
