Adolescent et soins, vers une autonomie de la volonté ?

Current regulations recall the right of minors to receive information and participate in the decision making process concerning their health care, but do not recognize the right of minors to consent to treatment. The paradoxical legal texts even state that the minor has the right to not divulgate medical information to his/her parents under the condition (among others) that a major person, freely chosen by the minor, consents to the treatment. Parental consent is the fundamental principle of the current law, without distinction concerning legitimate and illegitimate offspring, separated or divorced parents. The parental authority is a common right shared by the two parents when making decisions concerning their child's health, but with participation of the child according to his/her capacity for discernment.
