Les quatre vérités : philosophique (aletheia), scientifique (apodicité), juridique (l’intime conviction), humaine (biosociopsychopathologie)

RésuméLa Justice repose sur l’établissement de la Vérité. Ce mot polysémique (Vérité) trouve ses racines dans la religion (la Révélation), la philosophie (Aléthéia), la science (apodicité et réfutabilité). La Vérité judiciaire est finalement décidée par l’instruction et l’intime conviction des magistrats et la majorité des voix d’un jury. Il existe aussi une Vérité psychologique ou même psychiatrique (humaine) qui croit pouvoir rendre compte rétrospectivement du discernement et des motivations des comportements criminels, déviants, et des infractions par les connaissances biopsychopathologiques, en fonction de l’état de la science. C’est ce qui est demandé aux experts supposés (psychiatres et psychologues), ce qui laisse croire à une possible Vérité expertale, pourtant très aléatoire, sauf dans certains cas évidents d’états psychotiques graves (dont quelques-uns se retrouvent néanmoins en prison !).

In France, Justice rests upon the establishment of the Truth. There are several concepts of “Truth”: Religious (Revealed), philosophical (Aletheia), scientific (cleary established), apodicity, refutability, (falsifiability) and “human”. The judicial Truth is finally decided by the magistrate (inner conviction) and the majority vote of a jury. Psychiatry and psychology are required to find the human Truth-to explain misbehaviours and crimes by way of expert reports. There is also psychiatric or psychological Truth which attempts to differentiate between the motivations of the criminal and deviant behaviours to the current state of the science. This is what is asked of the (putative) experts (psychiatrists and psychologists).
