L’enfant en expertise. Le chemin de sa parole

RésuméL’acte médical « sous contrainte » de l’expert s’étaye sur la même démarche que celle du clinicien soignant. Les deux modes d’approche diffèrent essentiellement par les suites de la rencontre, laquelle est un cadre proposé pour user de la capacité à parler, penser ou du moins, pour en apercevoir la perspective ; où est recueillie une parole destinée à rester privée en consultation, à devenir publique dans l’expertise. En cherchant à s’humaniser, c’est-à-dire à tenir compte des faits en regard de l’auteur, la justice a dû s’exercer avec une marge d’incertitude liée à l’appréciation des différences. L’évolution actuellement vise à réduire cette marge en comptant sur l’expertise et amène certains praticiens à tenter d’évaluer la crédibilité du discours aux moyens de grilles d’analyse. La suggestibilité des enfants, nécessaire à leur développement pour accepter les contraintes et les connaissances se retournent ici contre eux, si l’expert n’y veille pas. La même évolution est observée en psychiatrie, à propos de la classification, délaissant une clinique du sujet au profit d’une approche descriptive de signes isolés, donc plus aisée à partager. En cédant aux pressions du corps social, les experts s’exposeraient à chercher à résoudre l’équation asphyxiante du réel et du rationnel au détriment de la pensée et des interactions humaines, seuls domaines de compétence que devraient toujours pouvoir revendiquer les psychiatres.

The expert witness's medical act, bound by his judicial role, finds its source in the same reasoning as the clinician care-giver's. The two approaches differ essentially in what follows the encounter, the framework proposed to exercise the capacity to speak, think or least to perceive the perspective of speaking, where words destined to remain private during the consultation take on a public facet in the assessment context. In an attempt to become more human, for example, to take into account the events with regard to the person responsible for them, the courts have had to exercise justice with a margin of uncertainty related to the appreciation of these differences. Today's evolution aims to lessen this margin by relying on the assessment, which encourages some practitioners to attempt to evaluate the credibility of a speech act using a codified measurement instrument. Children's suggestibility, necessary to their personal development so that they accept restrictions and learning, is here turned against them if the expert witness is not attentive to this. The same evolution is observed in psychiatry in terms of classification, leaving behind clinical practice centered on the subject in favor of a descriptive approach of isolated signs, which are easier to communicate. By giving way to the pressures of the social body, expert witnesses may find themselves seeking to solve the asphyxiating equation of the real and the relational to the detriment of thinking and human interactions, the only domains of competence that the psychiatrist should always be able to assert.
